Scammed into buying fake Nokia Bluetooth Headphones

I have been scammed into buying some fake Nokia bluetooth headphones. It's not a case of the seller putting anything in small letters. Instead its a blatant misleading auction that leads you into thinking you are getting the original product.

Sellers response was "You should have asked me on the auction before buying".

I do not think I should have to do that as the auction should not be misleading in the first place.

I would not buy any of the Nokia BH-503's listed on TradeMe, they all appear to be fakes.

I forgot to ask, is there anything I can do except complain to TradeMe and post bad feedback?

Hi Mike and welcome to ScamBusters. The auction certainly gives not a
single hint that this person is selling fakes and you are entitled to a full
refund (including postage) under the Consumer Guarantees Act. The
auction heading says "Nokia Bluetooth headset" which implies that
you're buying a Nokia branded product.

I would email the seller again adding the info above and ask for a full
refund. Feel free to add a link to this thread. And please let us know how
you get on.
